Divorce and Separation

Park Square Barristers have extensive experience in handling complex high-value financial disputes arising from divorce and separation. We work closely with both our lay and professional clients to identify and value marital assets, including property, investments, pensions, and businesses.

Unmarried Cohabitation

We understand that non-matrimonial finances can be just as complex and highly charged as matrimonial finances. Our barristers have a wealth of experience in handling a range of non-matrimonial finance cases, including advice and assistance with:

  • Co-habitation arrangements: the financial implications of co-habitation, including ownership of property and other assets, and the division of property in the event of a separation.
  • Civil-Partnerships: the financial aspects of civil-partnership dissolutions, including the valuation and division of assets.
  • TOLATA Applications: the Trusts of Land and Appointment of Trustees Act 1996 and can assist with disputes related to co-owned property.
  • Cohabitation cases: disputes arising between cohabiting partners, including disputes over property, financial support, and other assets.

 Relationship breakdowns and children

Children are often at the centre of the discussions between parties following relationship breakdowns. Our barristers are adept at advising on issues relating to children and co-parenting and routinely act in cases involving claims under Schedule 1 of the Children Act 1989 for financial support for children, including claims for maintenance, school fees, lumps sum payments and housing.

Inheritance (Provision for Family & Dependents) Act

Our family finance barristers advise and represents individuals in cases where financial provision is sought under the Inheritance (Provision for Family and Dependants) Act 1975, which allows certain family members to make a claim against an estate if they have not been adequately provided for.

Disputes arising over the ownership of assets held in trust or inherited during a marriage or relationship require specialist counsel, and our barristers have significant experience in this often-complex field of law.

Pre- and Post-nuptial Agreements

Our barristers can assist with the drafting and negotiation of pre- and post-nuptial agreements, which can help to clarify financial arrangements and protect assets in the event of a future separation or divorce. We regularly deal with cases involving multiple parties and interveners, as well as cases involving complex issues of conduct.

Private FDRs

Due to the continued pressure on the family justice system to handle the increasing numbers of cases that require court time, Private “Financial Dispute Resolution Appointments” (FDR) are becoming an increasingly popular way for parties to reach a final settlement of the financial issues arising from a divorce or separation.

These appointments can be held in our spacious and comfortable Chambers, and our barristers are adept at conducting these private negotiations and hearings, which invariably result in the parties reaching agreement, or there being a narrowing of the issues that aid resolution shortly afterwards.
