The Defendant fell to be sentenced to the minimum term of 3 years’ imprisonment as a “third striker”, having previous convictions for 16 burglary offences, 6 of which involved dwellings. In mitigation, Mollie successfully argued that the circumstances justified departure from the minimum sentence as there was no intrusion or search of the property, no damage or disturbance to the property, the property stolen was not of significant or sentimental value, and the offence was opportunistic. Further, his last burglary dwelling conviction was in 2017, and since then his offending largely involved non-dwellings. The Defendant avoided the mandatory minimum sentence and was sentenced to 24 months’ imprisonment.
