On 1st July 2021 The Court of Appeal heard the 2 appeals referred to above consecutively in order to provide new guidelines as to when it is appropriate to hold a finding of fact hearing. Huw Lippiatt appeared in the first appeal led by Will Tyler QC and David Orbaum appeared in the second.

After a contested finding of fact hearing before Cobb J in early 2016, the parents were found to have held radicalised views although no findings were made as to the parents’ ultimate destination once they had left the UK.
