Breach of Trademark Offences and new Guidelines

The City of London Police Force (Economic Crime Unit) together with the Specialist Fraud Division instructed Mr Nadim Bashir to prosecute the infringement of both the Apple Inc and Samsung brand trademarks by a Mobile Telephone wholesaler and retailer in West Yorkshire over a 7 year period by selling counterfeit batteries passing them off as original or genuine branded mobile telephone batteries manufactured by Apple and Samsung.

The defendant pleaded guilty to two offences against the Trade Marks Act 1994 at Huddersfield Magistrates court and was committed to Leeds Crown Court for sentence.

The sentencing exercise involved the new Sentencing Council guidelines for the Unauthorised use of a Trademark by “Individuals” which do not come into effect until the 1st October 2021.  There are separate guidelines that apply to “Organisations”

Appearing before HHJ Khokhar defendant was sentenced to 20 months imprisonment for selling counterfeit batteries and 8 months imprisonment for possession of counterfeit batteries, both sentences to run concurrently so 20 months in all suspended for 18 months.

In addition, he received a Community Order consisting of 250 hours unpaid work and a Curfew for 3 months.
