Hafsah Hussain secures acquittal of man charged with harassment, burglary and attempted burglary

Hafsah’s client was remanded in custody and appeared before the court for trial on 4 offences featuring harassment, burglary of a dwelling and two attempted burglaries of a dwelling.

At the start of the trial, the prosecution had amended the charges featuring a dwelling to a non-dwelling burglary and attempted burglary.

Hafsah effectively cross-examined the complainant on the absence of a course of conduct amounting to harassment, made submissions on the limits of the CCTV available in the case, as well as referencing case law supporting the assertion that the persisting issue of identification means that any conviction cannot be safe.

Hafsah’s client was found not guilty on all charges and was released from custody.
