Helena Spector appears against Queens Counsel in an environmental prosecution brought by the City of York Council.

Helena Spector was instructed by York City Council to prosecuted a well-known York-based restaurant, Ate O’ Clock, charged with of an offence under Section  34(1)(a) and (6)of the Environmental Protection Act 1990. The defendant company were represented by Queens Counsel.

The case involved discussion of the correct approach to sentencing for offences under the Environmental Protection Act 1990 that have no specific sentencing guidelines and dealt with the issue of the evidential threshold required to establish categories of harm for sentencing environmental offences. The case was found to be a Category 3 negligence offence (micro turnover) and the defendant company received a fine of £1000 plus costs.
