Joseph Hudson secures acquittal in two week GBH trial with expert neurological evidence

The case involved two defendants accused of causing skull fractures to another man by forcibly ejecting him from a pub.

The defence was that the defendants’ actions did not cause the injuries and that in any event reasonable force was used to eject an aggressive man from a pub. Neurological experts were instructed for both the prosecution and defence, as it was documented that the complainant hit his head in hospital after he went to ground outside of the pub but before the CT scan which revealed skull fractures.

The prosecution sought to prove that blood was emanating from inside the complainant’s ear canal when he was on the floor outside the pub. After careful cross-examination, it became apparent that the prosecution could no longer sustain the GBH charge and Not Guilty verdicts were directed.

The prosecution proceeded with an ABH charge, but following closing speeches on a further causation issue relating to an earlier fall and reliance on reasonable defence of another, the jury returned verdicts of Not Guilty for both defendants.
