Lucy Brown successfully appeals Restraining Order in Court of Appeal

On 6th August 2019, Lucy Brown appeared before the Court of Appeal Criminal Division to appeal against a sentence imposed by the Bradford Crown Court. The appeal related to a Restraining Order which was made without limit of time and the terms of which, prevented the appellant from seeing his 4 children, with whom he had previously enjoyed regular contact facilitated by family members.

The basis for the appeal was that when the order was imposed, the Crown Court had failed to apply the principles set out the Court of Appeal in an earlier case. The appeal was successful with the length of the order being reduced to 5 years and the terms amended to allow contact with the appellant’s children to be arranged via specified third parties, as had been suggested at the original sentencing hearing.
