David Gordon Successfully Secures Murder Conviction
Park Square BarristersDavid Gordon, instructed by the CPS, recently secured the conviction for murder of Rojs Avaliani who strangled his partner to death at the house he shared with her in January this year.
The case involved thorny issues of causation with the defence arguing that although the defendant manhandled the deceased and held her by the throat it was not this which caused her death but rather acute alcohol intoxication. She was heavily intoxicated at the time of her death.
A trial in May resulted in the jury being discharged when they could not agree a verdict. At the retrial this month the jury convicted unanimously after a retirement of a little over three hours.
