James Holding secures acquittal of teaching assistant charged with breaking pupil’s arm

James Holding secured the acquittal of a teaching assistant charged with s20 grievous bodily harm against an 11 year old school boy following a three-day trial at Leeds Crown Court.

The child, who had severe behavioural difficulties and was described by staff as the most challenging pupil the school had ever had to deal with, sustained a broken arm during an incident of restraint. The defendant was a man of previous good character.

The defendant relied upon s93 of the Education and Inspections Act 2006 which covers the use of force by staff members in educational settings.

The trial was prosecuted by a Grade 4 CPS prosecutor.

James is a Grade 2 CPS prosecutor and regularly receives instructions to appear in the Crown Court on behalf of the prosecution and defence.
