Phillipa Hildyard secures a more onerous Sexual Harm Prevention Order in Appeal

Phillipa Hildyard has secured a more onerous Sexual Harm Prevention Order on behalf of Humberside Police during an appeal at the Kingston-Upon-Hull Crown Court.

Summary of the Case

The Magistrates Court at Beverley had previously imposed on Benjamin Lumby a Sexual Harm Prevention Order to protect females under the age of 16 from the risk of sexual harm he poses to them. Benjamin Lumby appealed to the Crown Court on the basis that Humberside Police had provided insufficient evidence to justify the making of the Order.

Subsequent to the making of the Order in the Magistrates Court, Humberside Police had gathered evidence to demonstrate that Benjamin Lumby had begun targeting vulnerable girls aged 16 using the same methods.

During the appeal, Phillipa Hildyard argued that Benjamin Lumby had been deliberately attempting to circumvent the protective measures imposed by the original Order to continue his abusive activities on girls who were only marginally older but just as vulnerable.

His Honour Judge Jack and his colleagues rejected Benjamin Lumby’s appeal, finding that he was a “cynical sexual predator” who is “prone to violence in relationships with women”. The Court also found that girls aged 16 and 17 must be protected from him and varied the Sexual Harm Prevention Order to protect females under the age of 18.

The Court also made an order for costs, requiring Benjamin Lumby to pay £1,600 to Humberside Police.
