Park Square BarristersThe Company had been charged with a breach of Regulation 13(1) of the Construction (Design and Management) Regulations 2015, in that it was alleged that it had failed to plan, manage and monitor the construction phase of a project that involved the conversion of a number of barns into dwellings. A sub-contractor’s employee had fallen from an internal platform in one of the plots. The absence of edge protection had exposed workers to a risk of death and the HSE, prosecuting, submitted that the appropriate fine should have had a starting point of £160,000, within a range of between £100,000 and £250,000. Following agreement in relation to a basis of plea and both written and oral submissions, the judge imposed a fine of £18,000.
