Phillipa completed her pupillage under the supervision of Craig Hassall, the Head of the Regulatory and Public team at Park Square Barristers. Phillipa observed Craig prosecute in a broad range of regulatory crime cases, including on behalf of the Health and Safety Executive and Fire and Rescue Authorities.

Between March 2016 and September 2016, Phillipa was seconded to Humberside Police Legal Services. During that time Phillipa advised and represented the Chief Constable of Humberside Police across a wide range of issues. This included making applications for orders in the Magistrates’ Courts, Crown Courts and Family Courts, defending civil claims against the police, attending care proceedings on disclosure issues, and advising on issues such as legal professional privilege, police property disputes and dangerous dogs. As a result of undertaking such a significant amount of work for the police during this period, Phillipa gained a unique insight into and a comprehensive knowledge of police law.

Phillipa has also prosecuted on behalf of HMRC and attended inquest hearings. She is keen to develop her regulatory practice in all areas.

Police Training

Phillipa has provided training to the police on the following topics: Domestic Violence Disclosure Scheme, disclosure between the family court and police forces, police property, civil orders in the criminal courts (SHPO, SRO, VOO, Notification Orders), and warrants of further detention.

Notable Cases

  • Chief Constable of Humberside Police v Benjamin Lumby (October 2016) – Phillipa successfully defended the appeal against a Sexual Harm Prevention Order in Hull Crown Court over a 4-day hearing with vulnerable witnesses. The Court varied the SHPO to make it more onerous. It was reported in the national press. Further information, please click here.
  • Chief Constable of Humberside Police v Glyn Martin (2016) – Phillipa represented the Chief Constable of Humberside Police in an application for a Sexual Harm Prevention Order. The application was successful and a Sexual Harm Prevention Order was imposed, including a term requiring Glyn Martin to be tracked by a location-monitoring device at all times.
  • Re AS (2016) – Care case in which a child to the family had died. Phillipa represented the Chief Constable of Humberside Police in the numerous case management hearings in the High Court (Family Division), making representations in relation to disclosure of the police evidence into the family proceedings.

Phillipa Hildyard frequently appears in the Magistrates Court covering a wide range of offences and hearings for both the prosecution and the defence. She is regularly instructed on road traffic matters and has had recent success running a special reasons argument on the basis of a laced drink. She also undertakes work in the Youth Court including in respect of more serious offences, such as robbery.

Phillipa also has experience in the Crown Court, and has attended preliminary hearings, mentions, sentencing hearings, hearings to vary Sexual Harm Prevention Orders and appeals from the Magistrates Court. She completed her pupillage under the supervision of Craig Hassall and David Orbaum and worked closely with senior members of chambers who appeared in Crown Court trials. Phillipa is an approved Level 1 Crown Prosecution Service Advocate Panel prosecutor. She is keen to develop her Crown Court practice.

Between March and September 2016, Phillipa completed a secondment at Humberside Police Legal Services. She is therefore extremely familiar with the civil orders which arise in the criminal courts, such as Sexual Harm Prevention Orders, Sexual Risk Orders, Notification Orders, Violent Offender Orders, Domestic Violence Protection Orders, and orders regulating dangerous dogs.

Phillipa also has experience with Proceeds of Crime matters and has appeared in hearings in relation to detention and forfeiture.

Phillipa Hildyard appears in both private and public children law matters in the Family Court, as well as Family Law Act injunctions.

Private Law

Phillipa is regularly instructed to represent parents where there are disputes over child arrangements, including residence and contact disputes, and applications for prohibited steps orders and specific issue orders. Phillipa also has experience in enforcement proceedings.

Public Law

Phillipa Hildyard completed her pupillage under the supervision of David Orbaum, a children law specialist. She had the opportunity to observe him and other members of Park Square Barristers in a range of public law proceedings in both the Family Court and the High Court, including those with issues of international jurisdiction, complex medical evidence, vulnerable witnesses and serious allegations including non-accidental injuries, serious sexual abuse and domestic violence.

Phillipa is now building her own practice representing parties in public law proceedings. She has represented Local Authorities in applications for care orders and supervision orders. Whilst seconded to Humberside Police Legal Services in 2016, she often represented the Chief Constable of Humberside Police in the Family Courts on issues of disclosure. Phillipa is has also advised Local Authorities in relation to disclosure into the Criminal Courts, including the redaction of social care records and public interest immunity.

Court Skills Training

Phillipa is able to provide training in relation to court skills. She has previously assisted Leeds Beckett’s BA and MA social-work students by facilitating a court skills training day, as well as delivering training for social workers at Wakefield MDC.
